FAMILY GREEN CARD
Adjustment of Status is the application procedure by which someone in the United States goes from having one immigration status, such as a temporary visa holder—or in some cases no immigration status at all—to having the status of permanent or conditional resident (green card holder), all without leaving the United States.
REMOVAL OF CONDITIONS
Removal of Conditions is required when the resident obtained their Green Card prior to being married for 2 years to their petitioning spouse. The government authorizes a 2-year conditional card for the new resident and requires that the resident return in two years and show that they are either still married in good faith to the same person or, if divorced, that the marriage was in good faith and legitimate, and ended for normal reasons. A divorced filing requires a waiver.
ASYLUM
The Asylum Application is the process by which a person can request asylum in the US from another country. There are various requirements to be fulfilled to be approved for Asylum; however, the initial application - both affirmative and court based or defensive - for asylum does not require much physical proof.
GREEN CARD RENEWAL
This is the process used to get more years or extend the expiration date on your current green card or lawful permanent resident card. You cannot use this application process to remove conditions on a conditional green card, but you can use it to request a ten year extension on your current card.
Temporary Protected Status (TPS) is a temporary immigration status provided to nationals of certain countries experiencing problems that make it difficult or unsafe for their nationals to be deported there. TPS has been a lifeline to hundreds of thousands of individuals already in the United States when problems in a home country make their departure or deportation untenable. This fact sheet provides an overview of how TPS designations are determined, what benefits TPS confers, and how TPS beneficiaries apply for and regularly renew their status.
U-VISA
The Department of Homeland Security (DHS) provides guidance for law enforcement on U visa certifications, which help certain crime victims who assist in investigations or prosecutions. The U visa, established under the Victims of Trafficking and Violence Prevention Act, allows eligible victims to stay temporarily in the U.S. while assisting law enforcement, with a path to permanent residency if requirements are met. Congress capped U visas at 10,000 per year to support vulnerable immigrant victims. If you think you may qualify, Allcanza can guide you through the U visa certification and application process.
